The landlord must carry out the following work to the premises, which must be completed by 13 November 2023: a. Install a window catch on the toilet window, or otherwise repair the catch, and ensure that the window is intact and operates to a reasonable standard of repair. b. Replace or repair the bathroom door lever so that it operates to a good standard of repair. c. Have a licenced building practitioner or weathertightness expert investigate the premises for a possible leak into the kitchen and bedroom ceilings and assess whether any repairs are needed. d. If the expert mentioned in the previous paragraph assesses that leak repairs are needed, the repairs must be completed by 22 December 2023.

The landlord must pay the tenant $20.44 for the filing fee.

The tenant claims that the landlord has not repaired some minor problems at the premises. The toilet window is missing a catch. The bathroom door lever doesn’t cancel back to a neutral position. The tenant wants the problems fixed.

Ms Bidois says her team have reported to her that the repairs for these problems have already been done recently. However, Ms Bidois has not been to the premises recently. Mr Peihopa lives at the premises and knows what is working and what is not. He tells me the repairs have not been done. I accept his evidence.

Under s 45(1)(b) of the Residential Tenancies Act 1986, the landlord has an obligation to maintain the premises in a reasonable standard of repair.

I am satisfied the problems do amount to the premises not being maintained to a reasonable standard of repair and I make orders accordingly.

If the work order is not being made by consent of both parties, the Tribunal must also make a monetary order as an alternative to compliance with the work order. The work orders are made by consent so no alternative monetary order is required.

Mr Peihopa also mentioned that the kitchen and bedroom ceilings have leaked as recently as three months ago. I make an order that the possibility of a leak is investigated and repaired if required.

Because Mr Peihopa has succeeded in his claim, the Tribunal orders the landlord to reimburse him for the cost of his filing fee.
