Aoalii Tuulua owes LDW Property Management Limited $10,496.50 (“the debt”) as set out on table below.
Aoalii Tuulua must pay rent and the debt as follows: a. By 104 weekly payments of $800.00, being $700.00 for rent and $100.00 for the debt. b. A final payment of $796.50, being $700.00 for rent and $96.50 for the debt. c. Payments will be every Wednesday, with the first payment on 16/08/2023 and continuing until 13/08/2025.
Payments will be allocated in the following order: rent, and the debt.
If the tenant fails to pay rent and the debt within 2 working days of the due dates: a. The tenancy at 12 Gray Avenue, Mangere East, Auckland 2024 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Reasons

Both parties attended the hearing.
The landlord has applied for termination of the tenancy, rent and water arrears and refund of the bond.
The rent records have been updated to reflect the rent at $700.00 throughout the tenancy.
The landlord is unable to prove that there was effective service of the notice of rent increase to the tenant’s address for service. At no time has the tenant formally advised the landlord that they may use their email address as an additional address of service.
The Tribunal therefore finds that the rent had not been validly increased to $750.00 on 22 August 2022 as the notice of rent increase dated 14 June 2022 has not been properly served on the tenant.
With the correct debt recorded as above, the tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
