The requirement for service of the notice of hearing under section 91A (2) Residential Tenancies Act 1986 is dispensed with and the matter is to proceed as if notice has been served ( see s.91B (2)(c) RTA).

Jarrod Michael Smith and Julia Clare Smith must take any of the tenant’s personal documents that have been left at the premises to the nearest Police station and obtain a receipt for them.

The landlord may dispose of the other goods left at the premises by the tenant as the landlord sees fit.

Reasons

The landlord attended this remote teleconference hearing.

Telephone calls were made to the tenant on the number provided at the allocated hearing time. The first call was answered but was disconnected. A second call could not be connected.

The application was filed more than two months after the end of the tenancy so the usual service rules no longer apply.

The application must be served either personally on the tenant, on someone over the age of 16 living at address where the tenant now lives, or by post to an address provided by the tenant within two months before the application was made. See section 91A(2) Residential Tenancies Act 1986 (“RTA”).

The application has not been served in accordance with these requirements.

Section 91B RTA provides if notice of the hearing has not been carried out in accordance with s 91A(2) RTA, and the Tribunal is satisfied that all reasonable efforts have been made to serve the notice, then the Tribunal may dispense with the requirements for service and proceed as if the notice has been served in accordance with the RTA ( see s.91B (2)(c) RTA).

The tenant has been in communication with the landlord by email as recently as 7 May 2023. That tenant email address has been used by Tenancy Services to give notice of this hearing. I am satisfied that all reasonable steps have been taken to serve the tenant with notice of these proceedings. I dispense with the requirement for service and proceed as if notice has been given.

The landlord has applied for the disposal of goods the tenant left at the premises at the end of the tenancy.

The landlord is unable to contact the tenant.

It is not practicable for the landlord to the return the goods to the tenant. The value of the goods is below the cost of storing, transporting and selling them. Therefore the landlord may dispose of the goods. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986.
