The landlord has applied for rent arrears, compensation, payment of the bond, and reimbursement of the filing fee following the end of the tenancy. Rent

The tenancy ended on 4 May 2023. The landlord provided rent records showing the amount owing at the end of the tenancy. The tenant accepted the claimed rent arrears. Cleaning, Rubbish, Repairs and Painting

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish.

The tenant must not carelessly or intentionally damage the premises.

The landlord claims $97.19 for the cost of cleaning the premises. The cleaning needed was relatively minor, but I accept that it was needed and that the cost is reasonable.

The tenant said that the premises were not reasonably clean when he was provided with the premises in February 2020 and the rubbish bins were full of rubbish. He said that he left the premises at least as clean as they were provided to him.

The landlord could not provide an ingoing condition report or photographs. The current agent was not the agent when the tenancy started, and they were not passed the ingoing report.

I have no reason to doubt the tenant’s evidence. He has made appropriate admissions in this case and his credibility was not put in doubt. It is not reasonable to expect the tenant to pay for some minor cleaning when the premises were not provided reasonably clean at the start of the tenancy and so I have dismissed the claim for cleaning costs.

The only other aspect of the claim that the tenant disputed is the rubbish bins. I accept his evidence that they were full at the start of the tenancy. Therefore, he should not have to pay for emptying them at the end of the tenancy. I have therefore deducted $60 from the claim that includes emptying the bins.

The landlord has succeeded at least to some extent and so I have awarded the filing fee.

The tenant has paid the landlord slightly more than his liability. But I have made no order for repayment because the payments were made voluntarily, and it is not reasonable in the circumstances to order the landlord to make repayment.
