- The tenancy of Rebecca Sine Temperley at 344 Mangawhai Road, Wellsford, RD5, Wellsford 0975, Studio is terminated, and possession is granted to the Landlord immediately.
- Rebecca Sine Temperley is to pay Pamela-Anne Richards and Peter Leon Richards $4,420.44 immediately, being rent arrears to 3 August 2023 ($4,400) and the application filing fee.
Reasons
- The Landlord attended the hearing by phone. The Tenant did not answer when called, three times, twice before the hearing and once at the Landlord’s request during the hearing.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord will provide rent records which prove the amount owing at the end of the tenancy but says $4,400.00 is the amount owing.
- The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
- Because Pamela-Anne Richards, Peter Leon Richards has wholly succeeded with the claim I must reimburse the filing fee.
