The tenancy of James Rogers at 2 Landsdown Court, Roslyn, Palmerston North 4414 is terminated and possession is granted to Peter Ranchhod, at 11.59 pm today Wednesday 19 July 2023.
The tenant is to pay the landlord $5,000.00 immediately being rent arrears to 19 July 2023.

Reasons

The landlord attended the hearing.
The tenant did not attend the hearing. I am satisfied that the tenant has been properly served with notice of the hearing. See section 91A RTA.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
Peter Ranchhod claims the tenant has sublet or parted with possession of the premises without his prior written consent.
The landlord’s only evidence of the tenant having sublet the property was a discussion with one person living at the property and the landlord’s observation that there a number of people at and about the property.
A party who brings a claim to the Tenancy Tribunal must prove on the balance of probabilities (more likely than not) that their version of events took place. Independent witnesses, corroborating documents and photographs are an important part of discharging this burden of proof.
In the absence of any further evidence, I am not persuaded on the balance of probabilities that the tenant has sublet part of the property.
It is quite possible that the tenant has arranged flatmates. I cannot see in the tenancy agreement any specific provision limiting the number of occupants of the property. The landlord could not direct me to any specific provision in the agreement limiting the number of occupants. The tenant is also permitted guests.
The landlord’s claim in relation to subletting is dismissed.
