- Hira Waiariki and Ani Waiariki owe Property Brokers Limited As Agent For John And Gwen Powell Toni Wanoa $1,243.30 being rent and arrears to 14 August 2023.
- If the tenants fail to pay $1,243.30 by 14 August 2023: a. The tenancy at 154 Queen Street, Wairoa, Wairoa 4108 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
Reasons
- The tenant was phoned twice but calls went to voicemail on each call.
- The landlord has applied for termination of the tenancy for rent arrears and refund of the bond.
- Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986.
- Rent is at least 21 days in arrears at the hearing date. The tenancy will terminate on 14 August unless rent and arrears are paid.
- However the landlord wants the tenants to be able to remain at the property and believes that with assistance from WINZ this tenancy can continue. It is up to the tenants to arrange to get that assistance. Filing Fee
- Because the landlord has been wholly successful with the claim, the filing fee of $20.44 is ordered.
