- Matapo Ann Koiatu must pay Kāinga Ora–Homes And Communities $3,114.29 immediately, being rent arrears of $3,114.29 to 6 September 2023 plus the filing fee of $20.44.
Reasons
- The landlord attended the hearing which was conducted remotely. Two attempts to phone the tenant were unsuccessful. Messages were left.
- The landlord has applied for rent arrears and has provided rent records which prove the amount owing.
- Because Kāinga Ora–Homes And Communities has wholly succeeded with the claim I must reimburse the filing fee.
- I note the tenant is more than 21 days in arrears. That is a ground for termination. Because the landlord had not applied for termination in the application, I did not terminate the tenancy.
- The tenant must understand that if the landlord applies for termination of the tenancy because the rent is 21 days in arrears, the Tribunal must grant the termination.
