Reasons

On 22 November 2022 I made an order terminating the tenancy and awarding Mr Almond rent arrears, reimbursement of a plumbing charge, and the filing fee 1 .

Mr Almond understood that application would be ‘held open’ to allow him to pursue other costs after re-taking possession.

Mr Almond seeks repairs and other costs totalling more than $40,000.00.

His claim, which must be treated as a new application, was filed on 6 July 2023. 1 Almond v Trent [2022] NZTT 4423000

Notice of the hearing must be served on the Respondent.

If an application is filed more than two months after the end of the tenancy, the notice can only be served 2 : a. By delivering it personally to the tenant; or b. By posting it to a contact address that the tenant has supplied to the landlord in writing within the 2 months before the application; or c. By delivering it to the place where the tenant now lives and giving it to any person appearing to be aged 16 years or older who appears to be residing at that place and who confirms that the tenant resides there; or d. By giving it to any solicitor or other agent of the tenant duly authorised by the tenant to receive service on his or her behalf.

Service has not been effected on the tenant.

Because of the size and complexity of the claim, the hearing cannot proceed until service has been effected.

The Tenancy Tribunal may consent to service being effected by some means other than those set out above, such as by email. In this instance Mr Almond has an email address for Mr Trent but does not yet have information to show that it is a current email address that Mr Trent uses. If he obtains such information, he may ask the Tribunal to give a direction to Tenancy Services for substituted service.

If Mr Almond obtains a current address for the tenant, he may contact Tenancy Services to serve notice and proceed with this application.
