Reasons

Both parties attended the hearing. Ms Taylor and Ms Clifton represented the landlord.

The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The application first came before the Tribunal on 30 August 2023.

It has been adjourned a few times to allow the tenant the chance to comply with the landlord’s breach notices.

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached their obligations by failing to remove rubbish, failing to keep the premises (including the gardens) reasonably tidy, and by failing to repair damage to the premises.

The landlord has served several 14-day notices on the tenant, but the breaches have not been remedied.

The landlord produced photos from an inspection on 7 March 2024. Little if anything has changed since the previous inspection in December 2023. The premises are still in a very poor state.

The Tribunal has taken a cautious approach here, but the time has come for the tenancy to end. It would be inequitable not to make an order terminating the tenancy given the state of the premises with little having changed since August 2023.

The unremedied breaches cannot continue. The tenant accepts that. Her concern was that she be given time to find somewhere else to live.

The landlord consented to a 1-month period before possession is given to the landlord. The tenant thought that a realistic timeframe.

The landlord does not seek any other orders now. There will likely be a further application for vacated costs.
