Reasons

The tenant attended in person.
The landlord did not attend. The electronic records indicate the landlord contacted the Ministry of Justice today to say they were unwell and wanted a copy of the application. However, no formal application for adjournment has been received.
The tenant arrived thirty minutes late.
The tenant has now moved out of the premises. She advised me that she does wish to proceed with the case. She says the purpose of her claim was to send a message to the landlord that she must treat her tenants better than she was treated.
It appears that the landlord uses the premises as a boarding house.
The tenant says that the landlord took a bond equivalent to three weeks’ rent but did not deposit the bond with the Bond Centre as required by s 66D of the Residential Tenancies Act 1986 (RTA).
Nor, the tenant says, did the landlord provide a written tenancy agreement as required by s 66C of the RTA.
Further, the tenant says, the landlord failed to take reasonable steps to ensure that her quiet enjoyment was protected from a neighbouring boarder who made excessive noise, in breach of s 66G(2) of the RTA.
The tenant also believes that the house does not comply with the Residential Tenancies (Healthy Homes Standards) Regulations 2019 (HHS) in respect to draught, insulation, and water ingress. She says the landlord also failed to provide HHS information on request in breach of s 45(1AC) of the RTA.
The landlord did not attend to contest the tenant’s claims. The Tribunal is not in a position to make any formal findings in the circumstances. However, it is noted that if the claims are true, the landlord would be liable to significant financial penalties. Therefore, it would be in the landlord’s interests to ensure that they comply fully with their obligations under the Residential Tenancies Act 1986 and the HHS.
