Both parties attended the hearing. Ms Luo appeared for the Landlord, the Owner, Mr Zhang and a mandarin interpreter. The Tenant also attended.
The landlord has applied for termination of the tenancy, water rates and rent arrears. Background
The parties previously attended the Tribunal in respect of applications 4565089 and 4558190 filed by both parties. An Order was made in respect of those applications by the Tribunal on 13 July 2023.

How much is owing in rent and water rates?

The landlord provided rent and water records which prove the amount owing at the end of the tenancy. The Tenant agreed that these were probably the amounts owing. Termination
Rent was at least 21 days in arrears on the date the application was filed.
The Tenant submitted that she had filed an application for exemplary damages and compensation but this was never determined at the previous hearing. She submitted the Adjudicator determined only the Landlords application but not the Tenants. These claims should reduce the amount of rent owing.
Upon perusal of the Orders made in case reference 4558190 and cross application 4565089, the Tenants application for setting aside the termination, work Orders, exemplary damages and compensation was determined. Orders were made and reasons given. The Tribunal advised Mrs Harris that her previous application was separate to today’s application and her claims had already been determined. These claims would not be reheard at today’s hearing.
The Tenant also submitted that the Landlord repeatedly in the past and unsuccessfully tried to get her terminated. In terms of rent arrears, the Tenant stated that the Landlord refused to provide her with bank account details for Work and Income New Zealand so that she could pay her rent. It was not until June 2023 when she received these. When the Tribunal asked why the Tenant did not pay the rent arrears at that stage, the Tenant responded that she should have.
In considering the rent summary and admission from the Tenant that the rent arrears were probably correct, I find section 55(1)(a) Residential Tenancies Act 1986 has been satisfied. The Tribunal must terminate the tenancy.
