The tenancy of Duryse Dani Netana Heads at 175 Conyers Street, Heidelberg, Invercargill 9812 is terminated, and possession is granted to Invercargill Property Management Limited, at 5pm on Tuesday 3 rd October 2023.

The landlord has applied for termination of the tenancy.

Should the tenancy be terminated?

The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.
The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so. In this case, there have been continued requests for the tenant to maintain the lawns and gardens.
A new lawnmower was purchased for the tenant and remains in the hallway of the home. The tenant accepts he has mowed the lawns once since the tenancy started in December last year.
There have been four notices to remedy in the last five months before filing the application.
The tenant accepts that this is his responsibility and had difficulty managing the outside of the property being a solo dad and working.
The tenant has breached his obligations.
It would be inequitable to refuse to terminate the tenancy because as the landlord has a right to have their property maintained. There is going to be a significant cost to remedy the lawns and gardens now.
It is hoped that the parties will come to an agreement regarding the bond. However there is no claim to refund the bond at this time.
