Reasons
- The landlord attended the hearing, represented by Ms Herbert. There was no appearance for the tenant.
- The landlord has applied for compensation for rubbish removal and reimbursement of the filing fee following the end of the tenancy.
- In the application there was also reference to an historical invoice for $321.41, but there was no copy on the file. The hearing was adjourned for 10 minutes to allow Ms Herbert to track the invoice and have it emailed to the Tribunal. After a few minutes Ms Herbert advised that no-one had been able to locate the invoice and so that part of the claim was withdrawn.
- Ms Herbert advised that the bond has been refunded to the landlord.
Did the tenant comply with their obligations at the end of the tenancy?
- The tenancy ended immediately by Tribunal order on 28 July 2023 in proceedings numbered 4617389.
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish. See section 40(1)(e) Residential Tenancies Act 1986.
- The landlord provided photographs showing that the tenant had left a considerable amount of items at the property. It seemed that no effort had been made to clear or clean the property. Ms Herbert advised that the tenant was allowed a further 12 days after the termination date to clear out the property, but she did not do so.
- The landlord submitted an invoice for $400 for labour for clearing the property and an invoice for $998 for bin hire. The amount of $1398.00 is ordered accordingly.
- Because Trust House Limited has wholly succeeded with the claim I must reimburse the filing fee.
