The landlord attended the hearing. The tenant did not attend.

The application was filed more than two months after the end of the tenancy so the usual service rules no longer apply.

The application must be served either personally on the tenant, on someone over the age of 16 living at address where the tenant now lives, or by post to an address provided by the tenant within two months before the application was made. See section 91A(2) Residential Tenancies Act 1986.

The application has not been served in accordance with these requirements.

The landlord has attempted to contact the tenant at the alternative address provided by her in the agreement but without success, as well as by phone and e-mail. I am satisfied the landlord has taken all reasonable steps to locate the tenant and bring these claims to her attention.

I note too that the landlord’s claim is limited to the amount of the bond. A previous application (4510329) also involved a claim by the landlord for payment of the bond and resulted in termination of the tenancy. The hearing of that claim was not attended by the tenant and I am prepared to infer that she is unlikely to have appeared today.

In those circumstances I am prepared to waive further service and hear the matter today.

How much is owed for rent?

The Order dated 29 March 2023 in application 4510329 terminated the tenancy on 31 March 2023. The tenant was ordered to pay the landlord $1,816.51 for rent arrears and the filing fee.

The landlord has since received 3 weeks’ rent payments totalling $1,605.00 so there are remaining arrears of $211.51.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

Photographs provided by the landlord show that the tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.

The evidence shows that a large number of rubbish bags as well as 2x 6m2 and 1 x 9m2 skip bins were required to remove the rubbish and major cleaning and some repair and repainting was required.

Invoices provided by the landlord (which do not include claims for labour or loss of rents) prove that the amount expended by the landlord to remedy the tenant’s breach was well in excess of the bond held but the landlord limits his claim to the bond, which is to be paid to him.
