- The tenancy of RUA-WAI NGAMETUA MARERAKI at 209 Centre Street, Heidelberg, Invercargill 9812 is terminated, and possession is granted to Cadak Properties Limited Colin James Bryant, at 5pm on Tuesday 7 November 2023.
- RUA-WAI NGAMETUA MARERAKI must pay Cadak Properties Limited Colin James Bryant $3,060.44 immediately, being rent arrears to 7 November 2023.
- The Bond Centre is to pay the bond of $1,520.00 (3520753-002) to Cadak Properties Limited Colin James Bryant immediately.

Reasons
- The tenant failed to attend the hearing. It is apparent that he in fact had sublet the property to a family member. The evidence is that there is a significant mess left behind and the landlord has been advised that the sub tenant is in fact in custody.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- Because Cadak Properties Limited Colin James Bryant has wholly succeeded with the claim I must reimburse the filing fee.
