The landlord is to provide the Tribunal with a current service address for the tenant Breeze Edwards and Jahvis Neffew Jellick.

If a service address for the tenant cannot be provided, the landlord may apply to the Tribunal for a direction that the application is to be served by some other means or that service be dispensed with.

If Dremaine Perana or Jahvis Neffew Jellick has evidence confirming that they have notified the landlord about the termination of their tenancy, it must be sent to remote.tenancy@justice.govt.nz with reference to the application number 4690836 in the subject heading no later than 2 weeks before the next hearing of this matter.

Reasons

Mandeep Kaur for the landlord and Dremaine Perana attended the hearing via teleconference.

Mr Perana said that the Jahvis Neffew Jellick and Mr Perana had terminated their tenancy sometime in 2022 and that Breeze Edwards was the only remaining tenant at the address.

Ms Kaur was unable to confirm this as she was not the managing property manager at the time.

Mr Perana said that he would be able to provide evidence of him and Mr Jellick providing notice of termination to the landlord.

Mr Perana is to send evidence of this to remote.tenancy@justice.govt.nz with reference to the application number 4690836 in the subject heading no later than 2 weeks before the next hearing of this matter.

The landlord said that the tenancy had ended on 31 st May 2023 and the application was submitted on 20 th September 2023. As the application was filed more than two months after the end of the tenancy, the usual service rules no longer apply.

In relation to Breeze Edwards and Jahvis Neffew Jellick, there was no evidence provided to show that the notice of hearing was served on the tenants personally, or on someone over the age of 16 living at the address where the tenants now live, or by post to an address provided by the tenants within two months before the application was made. See section 91A(2) Residential Tenancies Act 1986.

As the application has not been served in accordance with these requirements, the hearing cannot proceed against Breeze Edwards and Jahvis Neffew Jellick until effective service has taken place.

If the landlord cannot locate the tenants Breeze Edwards or Jahvis Neffew Jellick, despite making all reasonable efforts to do so, the landlord may apply to the Tribunal for a direction that the application is to be served by some other means likely to bring it to the tenant’s notice. Alternatively, the landlord may apply to the Tribunal for a direction that service be dispensed with. See section 91B Residential Tenancies Act 1986.
