Ms Clifton and Ms Taylor attended the hearing on behalf of the landlord.

The tenant, Mr Zhou, attended the hearing.

In the Tribunal Interim Order (No 2) dated 5 April 2024, I recorded that the hearing today was for Mr Zhou to prove, on the balance of probabilities, that his landlord through the previous property manager, RayWhite or the current property manager owed him $1,279.29. Was Mr Zhou’s account in credit?

At the start of the hearing, Mr Zhou handed up a copy of his handwritten notes. I won’t call his notes a reconciliation. I would say they were a “recollection” of what he paid to his previous or current property manager. There was no documentary evidence to support how much he paid or when he paid.

Because Mr Zhou did not always pay his rent on a set date and sometimes paid the difference using cash, sometimes paid his rent for two weeks after a week was in arrears. It was challenging to understand what his handwritten notes meant.

Based on Mr Zhou's handwritten notes, I was not satisfied, on the balance of probabilities, that he had proved that his previous or current property manager owed him $1,279.29.

Was the rent up to date?

However, to assist Mr Zhou, I went through the rent summary with Ms Clifton and Ms Taylor week by week, line by line, to determine whether Mr Zhou had any credit in his account.

It took a while to go through each week and record Mr Zhou’s irregular pattern of rent payments. I was not suggesting that Mr Zhou was behind on his rent. I was suggesting that the way Mr Zhou paid his rent did not assist him in understanding whether he was behind or overpaid.

After I reviewed the rent summary and ledger with Ms Clifton and Ms Taylor week by week, I concluded that Mr Zhou was up to date on his rent for the week ending 21 June 2024.

Mr Zhou owed rent for the week between 22 June 2024 and 28 June 2024.

As a result of my finding, Mr Zhou immediately made a bank transfer to the landlord in the hearing and paid this week’s rent of $780.

If the landlord receives the rent payment today, this means Mr Zhou is up to date to 28 June 2024.

Where to from here?

From now on, Mr Zhou needs to pay $780 every Friday. To avoid confusion, he should consider paying his landlord in one lump sum rather than making part payments by Internet banking transfer and part payments in cash. However, this is a matter for Mr Zhou to decide.

I also record that Mr Zhou needs to pay his rent for the week between 29 June 2024 and 5 July 2024 on 28 June 2024.

There would be no outstanding rent arrears whatsoever if Mr Zhou continues paying his rent every Friday. Water arrears

I have dealt with the water arrears in a separate application number 4885914 today. I won’t repeat my reasons here.

Mr Zhou confirmed he would pay the water arrears because Ms Clifton and Ms Taylor provided a breakdown of the actual water usage attributed to his dwelling. Filing fee

I declined to reimburse the landlord’s filing fee because Mr Zhou was not in rent arrears. The cost should lie where it falls.
