Both parties attended the hearing. The tenant had the assistance of a Korean interpreter.

The landlord applied for termination, refund of the bond, rent arrears and costs for removing a prefab dwelling on the premises.

There were two fixed term tenancies affecting these parties and these premises. The first commenced on 1 February 2022 and ended on 1 February 2023. The second commenced on 31 January 2023 and ended on 31 January 2024.

On 8 December 2023 the landlord gave notice to the tenant that the fixed term tenancy due to expire on 31 January 2024 would not continue beyond the expiry date.

At the hearing the tenant indicated that he had vacated the main house on the premises but continued to occupy the premises with his business and five tiny homes that he has constructed or was in the process of constructing.

The tenant asked for further time to locate land to move the tiny homes to. The tenant asked for a further three months.

The landlord has applied for possession of the premises following the termination of the tenancy.

At the hearing the landlord produced documents that she had received from the Official Assignee. The documents include a Notice of Disclaimer of Property dated 30 January 2024. That notice states that, The Official Assignee, as liquidator of Uptown Holdings Limited (in liquidation) has on 30 January 2024 disclaimed the following property pursuant to section 269 of the Companies Act 1993: •Residential Tenancy Agreement between Ahn-Song Family Trust (landlord) and Uptown Holdings (tenant) signed 31 January 2022 and 25 January 2023 relation to 300 State Highway 16 Kumeu.

According to the Companies Act the disclaimer brings to an end on and from the date of the disclaimer the rights, interests, and liabilities of the company in relation to the property disclaimed 1 . Rent arrears and costs

The claim for rent arrears and costs are dismissed as the claim has not been established on the evidence before the Tribunal. In order to determine the tenant’s liability for arrears and costs the Tribunal needs to have the bankruptcy date for the tenant.
