The Landlord attended the hearing.

The Landlord’s application was filed on 3 November 2023 which was more than two months after the tenancy ended on 8 November 2022. The Landlord had not satisfied the requirements of section 91A(2) of the Residential Tenancies Act 1986 (“RTA”) in terms of service.

The Landlord sought a direction that the notification of todays Tribunal hearing via email correspondence to the Tenant be deemed sufficient service.

The Landlord submitted that on 8 November 2022, the Tenant wrote on a form provided by the Landlord their forwarding address was “130 Hesley Road” however there was no suburb details. The Landlord submitted that they had tried to email and telephone the Tenant but there was no response. The last time they attempted to contact the Tenant was around the time of mediation scheduled in November 2023. The Tenant did not attend.

The Landlord submitted there was no emergency contact details for the Tenant and they were not aware of any employment details.

Section 91B(2)(c) RTA provides that the Tribunal may dispense with the requirement for service and proceed as if the notice was served on the party in accordance with the RTA.

In considering the evidence, I find that the Landlord has attempted to contact the Tenant via email correspondence and telephone. The Tenant did not respond. The Tenant failed to provide adequate forwarding address details or an emergency contact. A notice of hearing was emailed to the Tenant using the email address the Tenant provided. I am satisfied the Landlord has taken all measures to attempt to serve the Tenant and I direct that the requirement for service is dispensed with.

The landlord has applied for rent arrears and has provided rent records which prove the amount owing.

As name suppression has not been sought, this has not been granted.
