Reasons

I first heard this application by phone on 20 March 2024.

The landlord has applied to terminate the tenancy for the tenant’s failure to comply with a breach notice requiring her to remove accumulated items from the exterior of the premises.

I adjourned the hearing with directions. I asked the tenant to provide photos after she had tidied the exterior of the premises and I asked the landlord to conduct an inspection.

Each complied with those directions. The hearing concluded on 26 March.

The tenant’s photos show that she has tidied the exterior of the premises considerably. It appears now to be in a reasonable state of tidiness.

The landlord acknowledges the work done but is concerned at the tenant’s former partner saying that he and the tenant intend bringing more goods to the property to sell and to make money.

The Tribunal is aware that the tenant is soon to give birth. It has taken a cautious approach because of that.

Also, the tenant said she is looking for a new tenancy.

The Tribunal is not prepared to terminate the tenancy now. The tenant has taken steps to tidy the exterior of the premises and the photos produced show that.

But the landlord’s concern is well founded. The tenant and her former partner do not seem to fully appreciate that they must keep the exterior of the premises reasonably tidy. That they wish to make money by selling goods brought to the premises does not excuse them from their statutory responsibilities.

I have decided to leave open the application for 4 weeks. The landlord can ask to have the application set for hearing again during that time if the tenant begins to accumulate more goods.

If the tenant accumulates more goods during the next month, the Tribunal will likely terminate the tenancy. So, the fate of the tenancy is very much in the tenant’s own hands. Mr White, who gave evidence at the last hearing, should do all he can to facilitate compliance with this order.
