Veenahari Investments Limited is to take reasonable steps to assess the market value of the tenant’s goods that remain after that date and time.

If the costs of transporting and selling the tenant’s goods is greater than their market value, then the landlord may dispose of them as the landlord thinks fit.

If the costs of transporting and selling the tenant’s goods is less than their market value, then the landlord must sell them and deduct from the sale proceeds any reasonable cost of their sale and storage.

The landlord may dispose of any goods that have no saleable value.

Reasons

The hearing was held by teleconference on 18 January 2024. Both parties attended the hearing.

The landlord has applied for the disposal of goods the tenant left at the premises at the end of the tenancy.

The tenant was evicted on 16 November 2023. He had not removed all his possessions which remain at the premises.

The landlord contacted the tenant to make arrangements to collect his belongings, but without success.

The tenant has since been trespassed from the property.

The landlord has applied to the Tribunal for an order under section 62B Residential Tenancies Act 1986 (“RTA”) which provides that the Tribunal must make an order for the return of the goods to the tenant or, if that is not practicable, for the sale or other disposition of the tenant’s goods.

The Tribunal may make such an order that is not to take effect unless the tenant has had the opportunity to collect the goods within a specified period.

The tenant explained that he was only given 3 days’ notice. He is wheelchair bound and was unable to arrange someone to help him to move the items remaining at the premises. The tenant says he has tried on numerous occasions to make arrangements to collect his belongings but did not receive a response from the landlord. He asked for more time within which to remove his goods from the premises.

In these circumstances, it is appropriate to allow the tenant to remove his belongings from the garage at the tenancy address on Saturday 27 January 2024 during the hours of 9 am to 5 pm.

Any items that the tenant does not remove, the landlord may dispose of, having made all reasonable steps to assess their market value.

The landlord may dispose of any goods that have no saleable value.
