- Team Chb Limited is granted possession of the premises at 15 Hartgill Crescent, Dannevirke, at 12 noon on Wednesday 13 December 2023.
- Rangi Mason must pay Team Chb Limited the sum of $20.44 immediately.
Reasons
- Both parties attended the hearing, which was conducted remotely. Mr Mason’s partner, Nicola Ratima spoke on his behalf,
- The landlord has applied for possession of the premises following the termination of the tenancy.
- The tenancy ended on 17 November 2023, as a result of a valid 90-day notice which was served on them on 18 August 2023. The requirements of 64(1) of the Residential Tenancies Act 1986 are met.
- The property has sold and settlement was to have been on 20 November 2023.
- The tenants have not vacated the property. They have continued to pay the rent. They have had difficulty finding another property.
- The tenants said that the property manager had told them she would find another property for them. The property manager denies that she made any promise of this nature.
- The property manager was under no obligation to find them somewhere else to live, and the termination was not contingent on the tenants having somewhere else to go.
- I have decided to allow the tenants a few more days to move out of the property and make arrangements to find somewhere else to stay. However, they must have moved out by 12 noon on Wednesday 13 December 2023. The tenant’s responsibilities, including payment of rent continue until then.
- Because Team Chb Limited has wholly succeeded with the claim I must reimburse the filing fee. .
