Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenant has breached their obligations by causing or permitting damage to the premises. The damage is extensive and includes the hallway wall and cupboard door, toilet door, bathroom door, all 3 bedroom doors, and the walls in bedroom 2.
The landlord served a 14-day notice on the tenant on 18 October 2023, and the tenant did not remedy the breach within the required period.
It would be inequitable to refuse to terminate the tenancy because the damage is significant, only a minimal attempt has been made to repair some damage which was first recorded back on 19 June 2023, and further damage has occurred incrementally over for the last 3 or 4 inspections. The landlord carried out a property inspection today and found further damage as the lounge window is smashed and there is a hole in the exterior cladding (photographs provided).
As the landlord has wholly succeeded with the claim, the tenant must reimburse the filing fee.
