Both parties attended the hearing by telephone.

This remote hearing was to consider the landlord’s application for termination.

The landlord sought termination due to rent arrears. At the date of hearing the rent arrears were seven days in arrears. The landlord had not issued the tenant with a 14-day breach notice in relation to the arrears. There are no grounds for termination due to rent arrears.

The rent summary submitted by the landlord does not contain a running total of arrears. An appropriate rent summary containing a running total of arrears should be provided for the next hearing. That summary should not include payments such as for the bond.

The landlord referred to a breach notice in relation to more people residing at the premises than the tenancy agreement provides for. The agreement records that only four people can reside at the premises. The tenants advised that when they moved in there were two adults and four children and that the landlord was aware of this.

The breach notice does not refer to the limited number of residents and instead refers to someone over the age of 18 years residing at the premises. I note at clause 9 (page 4) of the tenancy agreement that only occupants named on the tenancy agreement are to reside at the property. I am not aware of any legislation requiring all adults living in a tenancy to be named tenants.

At the hearing the tenants advise that the person who was the subject of the notice has left the premises. Therefore, the breach, if one existed, has been remedied.

There are no grounds for termination of the tenancy. The application for termination is dismissed.

The remaining claims are adjourned to a face-to-face hearing to be held before any Adjudicator. The following directions are made in relation to that hearing: (a) The landlord is to submit an adequate rent summary that only contains rent payments and includes a running total of arrears; (b) The landlord is to submit the detailed test results from the methamphetamine testing; and (c) The landlord is to provide evidence from the insurance company in relation to any remediation required for any methamphetamine contamination.

The parties will be notified in writing by Tenancy Services of the date and time of the next hearing.
