Dora Taumafa Vaiotu must pay the debt in order 1 at the rate of $10.00 per week.
The next payment must be made on Wednesday 20 March 2024 and payments must continue every Wednesday thereafter until the debt is paid in full.
If Dora Taumafa Vaiotu fails to make any payment within 2 working days of the due date, the balance of the debt owing will be payable immediately and can be enforced through the District Court.

Reasons

The landlord attended the hearing which was held by teleconference. The tenant did not attend. The tenant was contacted 3 times on the contact number that she provided to the Tribunal, but the calls were unsuccessful. The absence of a party does not prevent the hearing from proceeding. I note the tenant had contacted the court on 6 March 2024 and updated her contact details including her contact number and email address for the Tribunal to send all documents and updates. I am therefore satisfied that there has been adequate service of the hearing notice and proceeded with the hearing in the tenant’s absence.
The landlord has applied for compensation for rubbish removal following the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
On the evidence provided by the landlord, I am satisfied the tenant did not remove all rubbish from the premises at the end of the tenancy.
The landlord relied on a final property inspection report and photographs. The photographs show a number of items and piles of rubbish inside and around the outside of the house in breach of the tenant’s legal obligation. The landlord’s evidence is undefended.
The amounts ordered are proved.
The landlord has advised that the tenant has been paying $10.00 per week towards the debt. This started on 31 January 2024 and payments have continued since. This was supported by a “Damage Statement” produced by the landlord. The landlord has accepted the instalment payment plan arrangement, as ordered above.
Should the tenant not comply with the instalment payment plan, the balance of the debt owing will be payable immediately and can be enforced through the District Court.
