The tenancy of Kora George and Charleen Tau at 17C Selwyn Avenue, Avenues, Whangarei 0110 is terminated, and possession is granted to I-Rentals Limited (as agent for Karen Strong, as trustee of the Trevor Gordon Strong Family Trust) at 12.00 noon on Monday 12 February 2024.

Kora George and Charleen Tau must pay I-Rentals Limited (as agent for Karen Strong, as trustee of the Trevor Gordon Strong Family Trust) $20.44 immediately, being the filing fee for this application.

Reasons

Background

The application seeks termination of the tenancy on the grounds that the tenants have dogs at the premises, in breach of the terms of the tenancy agreement.

The landlord brought a similar application in September 2023.

On 10 November 2023 I made an order in respect of that previous application 1 . The order stated that the tenants were to have the carpets professionally cleaned and de-odorised by 8 December 2023.

In the reasons for the decision, I noted that Mr George stated he had dogs at the property for a period of time, but he had since given the dogs to the SPCA. Findings

Ms Raymond represented the landlord at the hearing today, 7 February 2024. There was no appearance by the tenants.

Ms Raymond advised that: a. On 19 December 2023 she was at a neighbouring unit to carry out a routine inspection. She knocked on the door of this property heard at least one dog barking inside. She heard two females talking, but no-one answered the door. b. On 24 January 2024 she carried out a routine inspection of this property. The smell of dog was extremely strong – worse than before. c. The tenants have not provided any evidence to show that they did the commercial cleaning and de-odorising required by the previous order.

The Tenancy Tribunal may make an order terminating the tenancy if: a. The tenants have committed a breach of the terms of the tenancy agreement or of the Residential Tenancies Act 1986; and b. In the case of a breach that is capable of being remedied, the landlord has given the tenant a notice describing the breach and giving the tenant a period of not less than 14 days to remedy the breach; and c. The tenant has not remedied the breach within the notice period; and d. The nature and extent of the breach is such that it would be inequitable to refuse the request for termination.

I-Rentals sent a 14-day breach notice on 16 August 2023. The notice identifies the dog odour and the fact that tenants are not permitted dogs in these units.

The breach in respect of the odour was not remedied. I do not know whether the tenants did remove the dogs, as Mr George stated they did, but if they did remedy the breach at that time it seems that they are now in breach again.

The tenants failed to take their opportunity to remedy the breach and save their tenancy.

The nature and extent of the breach is such that it would be inequitable to refuse the request for termination.

The tenancy is terminated.

The landlord has been successful in this application, and I must award the landlord the filing fee for the application.
