- The Bond Centre is to pay the bond of $3,000.00 (3247879-009) to Vo Dang Khoa Nguyen and Vu Dan Thuy Phan immediately.
Reasons
- The landlord attended the hearing by telephone. The tenant did not attend the hearing.
- An earlier hearing was held on 13 September 2024. That hearing was adjourned to enable the landlord to file photographs of the premises in support of his claim.
- The landlord seeks refund of the bond of $3,000.00 to offset the damage caused by the tenants. He does not seek an award over the bond amount because the tenants have been deported from New Zealand and enforcement is likely to be unsuccessful.
- The photographs filed by the landlord show significant damage to the premises which were used by the tenants for growing marijuana. There are holes in the walls and ceilings and pipes going between rooms.
- I am satisfied that the cost to repair the damage exceeds the amount that the landlord is seeking. I therefore refund the bond to the landlord as sought.
