Ms Sidhu attended the hearing for the applicant landlord.

The tenants did not attend the hearing.

The application was filed on the 9 January 2024 by Ms Urquhart who was the former property manager at both CSI Property Management and New Age rentals trading as Harcourts Property Management.

Ms Urquhart no longer works for Harcourts.

Ms Sidhu confirmed that the tenants were making regular payments of rent and that termination would not be sought.

Ms Sidhu submitted a rent summary; this shows that the tenants are still slightly in arrears. Ms Sidhu says that the tenants have told Harcourts that they don’t understand this as they are up to date.

When Ms Urquhart filed the application she submitted a rent ledger from CSI to 6 November 2023, the ledger from Harcourts starts on the 28 December, there is a gap where the Tribunal does not have a ledger from 6 November to 28 December. I have advised Ms Sidhu that I cannot make any award for rent when I have almost two months of ledger missing.

The same is true for water. Ms Sidhu provided me a ledger showing that the water rates from December to March 2024 have not been paid. I accept that this correct and the tenants should pay the water rates. However, Ms Sidhu wanted further time to ascertain what had been paid and what was owing for the water before December.

Ms Urquhart had submitted a water ledger showing that $325.00 was owed in October, but no ledger for November and December.

Given the issues with the evidence, Ms Sidhu asked for an adjournment, however I am reluctant to grant further time in the Tribunal to deal with this matter.

Ms Sidhu then requested to withdraw her application so that she can review the ledgers from CSI and Harcourts. I agree that this is the best course.

The tenants are liable for water in the tenancy agreement and on receipt of the water bills should be paying the water account.

The landlord has an obligation to keep accurate records of rent paid. I encourage Harcourts to reconcile both the CSI rent ledger and the Harcourt’s rent ledger and go over the rent ledger with the tenants, so that the tenants understand the amount, if any, of rent owing.
