This tenancy was for a fixed term to 12 April 2024. On 21 November 2023. The tenants advised the landlord that they were intending to move on 22 December 2024. The landlord replied by explaining options for early termination or assignment of the tenancy.

A fixed term tenancy may be terminated early if both parties agree. In this case the parties did agree, and the terms are recorded in the “break lease form”. That form is a template provided by the landlord to the tenant.

There is disagreement between the landlord over the timing of the tenant returning the completed “lease break form”. However, that timing is not particularly important to resolving this claim.

Whether it was returned in November (as the tenant claims) or December (as the landlord claims), the form is clear. It records an agreement for early termination of the tenancy on the basis that the tenant will be responsible for paying rent until a new tenant is found.
