Reasons
- The landlord attended the hearing which was held by teleconference. The Tribunal was unable to contact the other party. I proceeded with the hearing as I was satisfied adequate service of the hearing notice had been completed.
- The landlord has applied for rent arrears, water rates, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
How much is owed for rent and water rates?
- The tenants vacated the tenancy on 17 November 2023 without giving the required notice. The landlord claims rent arrears and rent in lieu of no notice. The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy.
Did the tenants comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The landlord proved on the evidence produced that the tenants did not leave the premises reasonably clean and tidy and did not remove all rubbish. The landlord’s evidence was undisputed.
- The amounts ordered are proved.
- As the landlord has wholly succeeded with the claim, I must order the other party to reimburse the filing fee.
