- The tenancy of Shane Hardley at 69A Resolution Road, Welcome Bay, Tauranga 3112 is terminated, and possession is granted to Tauranga Residential Rentals Limited T/As Quinovic Property Managment As Agent For Craig Gerzon, at 11.59pm on Tuesday 27 February 2024.
- The Bond Centre is to pay the bond of $1,899.02 to Tauranga Residential Rentals Limited T/As Quinovic Property Managment As Agent For Craig Gerzon immediately, calculated as shown in the table below.
- The remainder of the bond ($20.98) will remain at the Bond Centre until further order by the Tribunal or agreement between the parties.
- Application number 4786118 is withdrawn.
Reasons
- Both parties attended the hearing.
- The landlord has applied for termination of the tenancy, rent arrears, reimbursement of the filing fee and payment from the bond.
- Rent was at least 21 days in arrears on the date the application was filed and so, in the absence of an agreed payment plan, the Tribunal must terminate the tenancy. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing as at today’s date - $1,878.58.
- Further to this, because Tauranga Residential Rentals Limited T/As Quinovic Property Managment As Agent For Craig Gerzon has wholly succeeded with the claim I must order Mr Hardley to reimburse them the filing fee.
- As advised at the hearing, the amount owing will be paid from the bond. The $20.98 that remains at the Bond Centre after this payment will stay at the Bond centre until further order by the Tribunal or agreement between the parties.
