Reasons

Both parties attended the hearing via teleconference.

This is a cross application. The landlord is claiming rent arrears and reimbursement of the filing fee.

The tenant is claiming that the landlord has breached the fixed term tenancy by terminating her tenancy early.

The landlord has applied for rent arrears and has provided rent records which prove the amount of $830.00 owing. The tenant accepts that she is one week behind in her rent and says she will pay the arrears by 5.00pm on Friday 16 th February 2024. The rent is due again on Monday the 19 th of February 2024.

The tenant claims that the landlord has issued her with a 90-day notice to terminate while on a fixed term tenancy.

The tenancy commenced on 10 July 2023 and was a 12-month fixed term tenancy.

On 3 December 2023 the landlord served the tenant with a 90-day notice to terminate the tenancy by 3 March 2024.

The tenant does not seek exemplary damages but solely to be able to stay at the property until the end of her tenancy agreement. The fixed term tenancy ends on 14 July 2024.

The landlord advised that he has sold the property and the new buyer takes over the property on 4 March 2024. The landlord has not applied for an early termination of the fixed term tenancy.

It was the landlord’s belief that if the property was sold that the fixed term tenancy would end.

It was explained to the landlord that there are very few grounds for the early termination of a fixed term tenancy, and the landlord is not seeking to terminate the fixed term.

In the circumstances of today’s hearing and without any applications for me to consider, the tenants fixed term tenancy remains in place until 14 July 2024 unless the parties agree otherwise.

Because the landlord and the tenant have been wholly successful with their claims, I am not reimbursing the filing fee.
