Reasons

Both parties attended the hearing, which was convened to consider whether there should be a re-hearing of the order issued on 12 April 2024.

It was agreed that the tenancy will end on 31 May 2024 and the keys will be returned the following morning.

The tenancy will end both because valid notice not to extend the fixed term has been served and the tenancy is due to end on 31/5/2024 in accordance with that notice and due to the rent arrears that have accrued.

Should a conditional termination order be made?

The stay of proceedings issued with the order setting the matter for a rehearing provided that the rent must be paid until the matter was reheard.

Ms Begg has paid the rent since 12 April has also paid an additional $35 towards the arrears from that time. She undertook to continue those payments until the end of the tenancy. The conditional order is therefore also made by agreement.

The termination order is made because the rent was at least 21 days in arrears on the date the application was filed and continues to be in arrears, See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

The landlord has provided rent records which prove the amount owing.
