- The landlord’s name is amended and corrected to the name shown above with the landlord’s consent.
Reasons
- The hearing was held by telephone. Mr Montakim, representing the landlord attended the hearing. At the start of the hearing the tenant was called twice on the cellphone number provided on the application but did not answer either call.
- The landlord has applied for rent arrears, air conditioning usage costs, and reimbursement of the filing fee following the end of the tenancy. The Bond Centre forwarded the bond to the landlord prior to the hearing.
How much is owed for rent?
- The tenancy ended on 13 February 2024. The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy.
Is the tenant liable for the air conditioning costs?
- The tenant is liable for outgoings that are exclusively attributable to the tenant’s occupation of the premises. I am satisfied that the costs claimed for power related to use of the air conditioning use in the premises reasonably represent the tenant’s use during the tenancy.
- Accordingly I find the tenant is liable for the costs claimed.
- As the landlord has succeeded with its claim I must reimburse the filing fee.
