Shirley Metua is to pay Property Brokers Waikato Limited As Agent For; Gavin Maine, Letitia Maine & Vaughan Maine $20.44 immediately, being reimbursement of the filing fee.

Reasons

The landlord attended the hearing which was held by teleconference on Friday 12 April 2024. The tenant did not attend. The tenant was contacted twice on the contact number provided in the application but without success. I proceeded with the hearing in the tenant’s absence as I was satisfied adequate service of the hearing notice had been completed.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenant has breached their obligations by failing to pay rent when it falls due.
The landlord served a 14-day notice on the tenant on 26 February 2024, and the tenant did not remedy the breach within the required period.
It would be inequitable to refuse to terminate the tenancy because the tenant has a poor rental payment history which has been the subject of numerous 14 day breach notices and applications to the Tenancy Tribunal. Although the tenant is not currently in arrears with her rent, the Tribunal has no confidence that this will continue to be the case, given the rental history.
As the landlord has been wholly successful with their claim, I must order the other party to reimburse the filing fee.
