Reasons

The landlord attended the hearing, conducted via teleconference. Two calls to the tenant went unanswered and to voicemail. After the first call went to voicemail, a brief message was left introducing myself and explaining the purpose of the call. The message concluded with the advice I would try a second time after waiting some minutes. I was satisfied adequate service had completed and I continued with the hearing after the second call went unanswered.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenant has breached their obligations by failing to reside at the premises.
The landlord served a 14-day notice on the tenant on 13 March 2024, and the tenant did not remedy the breach within the required period. On 26 March 2024 she advise the landlord she was overseas. At an inspection earlier today, the premises was considered unoccupied.
It would be inequitable to refuse to terminate the tenancy because the tenant has indicated she is living overseas. The premises appear abandoned but no supporting evidence to prove this was provided.
