- This order is made by consent of the parties.
- Shaun Pearson and Alana Pearson owes Palmerston North PM Limited (T/A Quinovic Property Management) as Agent for KiwiRail Limited $920.44 (“the debt”) being $900 rent arrears to 24 May 2024 and 20.44 filing fee.
- Shaun Pearson and Alana Pearson must pay rent and the debt by a payment of $1,8020.44 on 25 May 2024, being $900.00 for rent, $920.44 for the debt.
- Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due date: a. The tenancy at 105 Clevely Line, Bunnythorpe, Palmerston North 4478 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
- If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.
Reasons
- Both parties attended the hearing by telephone.
- The landlord has applied for termination of the tenancy, rent arrears and payment of the bond. The tenants want to repay the debt to avoid immediate termination and the parties have agreed to the terms of this order.
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order.
- Rent was at least 21 days in arrears when the application was filed and so I have made the conditional termination order as agreed by the parties.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach.
