The landlord has applied for termination of the tenancy for abandonment through the expedited process under section 91AA Residential Tenancies Act 1986.

Are there grounds for an expedited application?

I am satisfied that the two requirements for the expedited process are met: a. The tenant does not want to contest the abandonment application. b. The information provided by the landlord with the application is sufficient to enable the Tribunal to determine it properly without a hearing (either on the basis of that information alone or with only minor clarifications).

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrears at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

This is a fixed-term tenancy, due to end on 2 August 2024. On 12 March 2024, the landlord visited the property, after not hearing back from the tenants about rent arrears issues, the tenants were not home and a relative of the tenants said they were overseas. After several attempts to contact the tenants about rent arrears, the landlord eventually spoke with them via whatsapp on 19 March 2024 and was told they were in India and unlikely to return. The landlord asked the tenants to confirm by email whether they wished to give notice to leave the property, but the tenants did not respond and have not responded to the landlord since. On 21 March 2024, the landlord carried out an inspection of the property. The landlord provided a detailed inspection report dated 21 March 2024, which included photographs. From the photographs provided, it was evident that almost all furniture had been removed, apart from a bare mattress on the floor, there was a lot of rubbish left scattered around the property, the hangars in the cupboards were empty, there was no power on at the property and the property manager said there were flies attracted to the rubbish left and an unpleasant odour from it, indicating no recent occupation of the property.

The landlord had sent a number of texts and emails to the tenants about rent arrears, copies of which were provided, without response.

The tenants have not contested the claim.

The landlord provided rent records which show there were rent arrears at the date of filing the application.

All the requirements for an expedited abandonment application have been met. Because the premises have been abandoned, and rent is in arrears, I am terminating the tenancy immediately.
