Both parties attended the hearing on 5 June 2024.

This was a rehearing of a matter previously heard by the Tribunal on 14 May 2024. Amongst other things, the 14 May 2024 Tribunal order required the bond of $2,760.00 to be released to the landlord.

The landlord applications are as follows; • The landlord seeks termination of the tenancy on the basis that the rent was 21 days or more in arrears on the day that the application was filed with the Tribunal. • The landlord seeks termination of the tenancy on the basis of having served 3 recidivist rent arrears notices on the tenant. • Rent arrears. • Reimbursement of the filing fee.

Termination. The landlord provided a rent summary showing that the rent was more than 21 days in arrears on the date that this application was filed with the Tribunal. The application was filed on 8 April 2024 (see s.55(1)(a) Residential Tenancies Act 1986(“RTA”).

The recidivist rent arrears notices served by the landlord did not comply with s.55(1)(aa) RTA and that application is dismissed.

The updated rent arrears summary shows that the tenant is in credit by $2,070.00 as of the date of this hearing.

Section 55(2) RTA provides that the Tribunal may refuse to make an order under subsection (1) if, but only if, it is satisfied that the breach has been remedied and the landlord compensated for any loss and it is unlikely that the tenant will commit any further breach of a similar kind in the future.

The breach has been remedied by the tenant. I am not aware of any other losses incurred by the landlord and I consider it unlikely that there will be further similar breaches.

In any event, the tenant is remined of the obligation to pay rent in full and on time.

The landlord application is dismissed.

The landlord has already received the tenant bond from Bond Services and confirmed that they were holding the bond. The landlord is to lodge the bond with Bond Services immediately.

No order is made with regards to the filing fee.
