The tenancy of Malo Kalolo at 20 Tomairangi Crescent, Pukekohe 2120 is terminated, and possession is granted to Kāinga Ora–Homes and Communities, at 3.30pm on Thursday 9 May 2024.
Malo Kalolo must pay Kāinga Ora–Homes and Communities $1,602.86 immediately, being rent arrears to 9 May 2024.
This order may be enforced immediately.

Reasons

The hearing was conducted by telephone. The landlord’s representative attended the hearing. The tenant did not attend. The call to the tenant’s mobile telephone was answered by her sister who said that the tenant was in Australia.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.
The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenant has breached her obligations by not living at the premises at all times as required by the tenancy agreement.
The landlord served a 14-day notice on the tenant on 14 March 2024, and the tenant did not remedy the breach within the required period. The tenant is not living at the premises now and it appears that she is living in Australia.
It would be inequitable to refuse to terminate the tenancy because as a social housing provider, the landlord must make the best use of its properties to meet the need for them. It cannot do that if properties are left vacant for prolonged periods.
The tenancy could have been terminated for abandonment and rent arrears as well.
The landlord has applied for rent arrears and has provided rent records which prove the amount owing.
Because the tenant is not living at the premises, I have allowed the landlord to enforce this order immediately.
