BY CONSENT – The tenant is to dispose of rubbish being a box, polystyrene and a hose located near to a pile of tyres at the property.

Order 2 above (to remove the box, hose and polystyrene) is to be completed by 6pm on Monday 22 July 2024.

The remainder of the landlord’s application relating to the disposal of items outside is dismissed.

The landlord’s application in relation to the inside of the property not being reasonably clean and tidy is withdrawn.

Reasons

Both parties attended the hearing. The landlord attended by telephone.

The tenant attended the hearing but after the above two orders were made by consent and after he was warned to be calm and to be mindful of his language as he was swearing, he left of his own accord.

The landlord says the property is not reasonably clean and tidy in breach of section 40(1)(c) Residential Tenancies Act 1986 and provided updated photographs of the outside of the property taken today.

The tenant agreed that all the items left by the side of the fence by the property would be put on his truck. He agreed to do this by 5pm on Wednesday 17 July 2024.

The tenant agreed to throw out a box, polystyrene and a hose which have been left outside along the fence line which he accepts are rubbish and can be thrown away. I accept that, given that the tenant says they are rubbish, this is not reasonably clean and tidy and I consider it to be reasonable that this is done by 6pm on Monday 22 July 2024.

The landlord wants the tenant to remove tyres, but the tenant says these are for his cars. The tenant disputes that they are rubbish. He says that they stacked and are not untidy. I decline to make an order in relation to the tyres. I do not find that having this amount of tyres stacked in an orderly way amounts to a property being unreasonably clean and tidy.

The Landlord asks for an order for the tenant to dispose of further items including a larger piece of wood, other smaller tyres, small wooden planks, and other miscellaneous items. A premises does not have to be immaculate. I am not satisfied that this is not overall reasonably clean and tidy so decline to make further order.

The landlord did not have updated photographs of the inside of the property so did not want to pursue this with this part of the application.

The landlord did not seek reimbursement of the filing fee.
