Reasons

The landlord attended the hearing; the tenant did not. I conducted the hearing in the tenant’s absence because I am satisfied the tenant was correctly served and knew about today’s hearing.

The landlord has applied for termination of the tenancy and possession of the property under section 55(1)(b) Residential Tenancies Act 1986: 55Termination on non-payment of rent, damage, or assault (1)Subject to subsection (2), on any application made to it under this section by the landlord, the Tribunal shall make an order terminating the tenancy if the Tribunal is satisfied that— (b)the tenant has caused, or has permitted any other person to cause, or has threatened to cause, substantial damage to the premises;

The tenant lives in a one-bedroom apartment in a complex of thirty apartments. His apartment is on the first floor.

The landlord provided information at the hearing that in February 2024 the landlord received a complaint from the tenant who lives below Mr Alfuzai that there was a leak and a strong smell of faeces coming from the apartment above, (Mr Alfuzai’s apartment).

On investigation by the landlord it was discovered that Mr Alfuzai’s shower and bathroom and apartment in general was strongly contaminated with urine and faeces. The plumbing in the shower was blocked, and the shower full of waste. Eventually the tenant below Mr Alfuzai’s ceiling collapsed and she had to be relocated to another apartment.

Photographs provided by the landlord show every room of Mr Alfuzai’s apartment to be full of bags of rubbish and rubbish that has not been bagged. The property is strongly infested with vermin and the vermin have spread to other apartments in the complex.

Despite the landlord’s attempts to engage with the tenant, and despite the landlord’s offers of assistance to the tenant, no progress has been made in remedying the state of Mr Alfuzai’s apartment or living conditions.

In this case I find the tenant has caused substantial damage to the property he is renting from Kainga Ora.

The grounds have been established and the tenancy must be terminated.
