Both parties attended a hearing on 18 June 2024. The landlord attended another hearing today. The tenant did not attend.

The landlord claims unspecified storage costs and an unspecified skip cost. None of the landlord’s claims were supported by documentary evidence, of either the tenant breach or costs incurred. The landlord has the onus of establishing its claims and must provide evidence. I directed that the landlord provide a breakdown of the costs claimed at least three days before the next hearing. The landlord did not do so and did not provide evidence at the hearing. All claims for rubbish removal and storage costs are dismissed.

The landlord’s claim also includes an application for the disposal of goods (a boat) that the tenant left at the premises at the end of the tenancy. The tenant acknowledged that he is unable to collect the boat. I made a disposal (subject to conditions) on 18 June 2024.

The landlord’s application estimates that the boat has a value above the cost of storing, transporting and sale. I directed that the landlord must sell these goods at a reasonable market price and must pay the proceeds of sale to the Bond Centre pending a final order under this application. See sections 62(3)(b), 62B(2),(3) and (4), 62C(1)(b),(2) and (3) Residential Tenancies Act 1986).

I also directed that, if after reasonable endeavours, the landlord is unable to sell the boat, it may ask the tribunal for further directions. I recorded that any such request must be supported by evidence of the steps taken to date. The landlord has not complied with the terms of the order, has not made a request for further directions and has not provided evidence of the value of the boat or attempts at sale.

At the hearing today, the landlord said that it now believes that the boat has no value and wants to give it away. As previously ordered, any request for a variation of the 18 May 2024, must be supported by proper evidence. There was no evidence and the landlord acknowledged that it had not listed the boat for sale. The 18 May 2024 remains, with all of its conditions.
