The landlord is to provide Tenancy Services with a service address for the tenant by 5.00 pm on Friday 20 December 2024.

If a service address for the tenant cannot be provided, the landlord may apply to the Tribunal by 5.00 pm on Friday 20 December 2024 for a direction that: a. the application is to be served by some other means that is likely to bring the application to the tenant’s notice, (with supporting

); or b. service be dispensed with altogether (with supporting reasons).

If Order 1 or Order 2 is not complied with, this application will be dismissed. Reasons:

The landlord attended the hearing which was held by teleconference; the respondent did not answer either of the two calls made at the scheduled time to the number provided to the Tribunal.

The application was filed more than two months after the end of the tenancy so the usual service rules no longer apply.

The application must be served either personally on the tenant, on someone over the age of 16 living at address where the tenant now lives, or by post to an address provided by the tenant within two months before the application was made. See section 91A(2) Residential Tenancies Act 1986.

The application has not been served in accordance with these requirements.

The hearing cannot proceed until effective service has taken place.

A hearing was held on 14 August 2024 at which a different Adjudicator made an order for substituted service on two named people.

On Friday 13 September 2024 and Thursday 19 September 2024, a Bruce Plunkett attempted to serve those people but failed. Although contact was made with a “family member” the respondent’s whereabouts and contact details were not ascertained and Mr Plunkett did not serve the notice of hearing on any person.

The service requirements included in the Residential Tenancies Act, 1986 (the “RTA”) include an obligation on the landlord to bring applications in a timely manner (two months following the end of the tenancy). See section 91A(1) of the RTA. After the expiry of this period, the effect of section 91A(2) of the RTA is that it can no longer be assumed that the respondent has retained the same email address, and the obligation on the respondent to collect mail from the tenancy address expires: More onerous service requirements come into play for the landlord.

I accept this is inconvenient for the landlord, but it is the direct result of the application being made more than two months after the end of the tenancy.

The respondent has a right to be informed of a claim being made against her.

There is no information before the Tribunal to suggest the respondent is being evasive.

No application has been made by the landlord that the application against the tenant is to be served by some other means that is likely to bring it to the tenant’s notice, or why it is that service should altogether be dispensed with.
