Reasons

Only the tenant attended the hearing which took place by teleconference. The landlord was called on the number provided four times and the calls went to answerphone. The file records that notice of the hearing was sent to both parties so the hearing proceeded.
The landlord has applied for reimbursement of insurance excess of $1000.00 for damage following the end of the tenancy.
This tenancy ended on 8 November 2023. The application was filed five months later in April 2024.
The hearing was adjourned on 19 August 2024 for service on the tenant. The tenant was personally served with the application and attended the hearing today.
The tenant advised that she disputes the claim for the following reasons: (a)All outstanding matters were resolved following the tenancy ending and amount was deducted from the bond for the landlord and the balance returned to her. (b)The landlord made this further claim after all matters had been resolved. (c)The tenant disputes responsibility for any further damage on the basis that there were ongoing maintenance issues during the tenancy; in particular the kitchen bench was substandard and not repaired properly when she raised the issue with the landlord, there were mould issues and electrical issues at the premises during the tenancy.
The applicant did not attend the hearing at the scheduled time or request an adjournment.
The applicant is required to establish the claim to the civil law standard of proof, on the balance of probabilities. The applicant has had since April 2024 to file evidence in support of this claim. The applicant has filed copies of communication with the insurance company but has not filed any entry photographs and exit photographs in respect of the damage claimed and any evidence of the age of the items damaged.
I am not satisfied that the claim is proved on the balance of probabilities, therefore the claim is dismissed.
