Notice was served on the tenant pursuant to s.53B of the Residential Tenancies Act 1986 (“RTA”).

Section 53B RTA allows Kainga Ora housing to terminate a periodic tenancy on 90 days’ notice where; • The tenancy was granted before 14 April 2014. This tenancy was granted on 21 February 2005. • Kainga Ora requires the tenant to transfer to different social housing and considers the transfer to be necessary or desirable. Kainga Ora requires access to the premises in order to access the premises for work required to meet its Healthy Homes Standards compliance obligations before the deadline of 1 July 2024. The tenant, despite repeated requests for access, has denied access to the landlord. • Other housing appropriate to the tenant’s needs is available. Kainga Ora has other housing on hold and ready for the tenant to relocate to.

I am satisfied that the requirements of s.53B RTA have been met and the application by the landlord for a possession order pursuant to s.64 RTA is granted.
