The landlord’s representatives attended the hearing. The tenant did not attend the hearing. The tenant was called twice but both calls went to answerphone.

The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached their obligations by failing to live at the property, living away from the property for more than 30 days, and allowing other people to live at the property without permission. (Clauses 13,14 and 15 of the tenancy agreement).

The landlord served a 14-day notice on the tenant on 12 March 2024., and the tenant did not remedy the breach within the required period.

I am satisfied that the tenant is not living at the property because: a) The tenancy manger has been to the property multiple times since February and has never seen the tenant there. b) Other people are living in the property. c) Another Kainga Ora property manager has reported that the tenant is now living at another address, and that she has been told both by the tenant and the person she is living with that the tenant is living at the new address. d) Other social agencies have reported that the tenant is no longer living at the property.

It would be inequitable to refuse to terminate the tenancy because the landlord provides social housing. The landlord’s homes are in demand and there is a shortage of supply of the landlord’s homes for families. The landlord should be able to utilise its homes to provide homes for those on its waiting lists who have the most need. It is in the public’s interests that tenants who no longer live in Kainga Ora homes should have their tenancies terminated which allows for another family who needs a home to have one.
