- The tenant did not appear today and was not able to be contacted. The landlord appeared by teleconference.
- The landlord has applied for compensation and reimbursement of the filing fee from the bond, following the end of the tenancy.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The tenant had ended the tenancy after becoming unwell.
- Exit inspection photographs provided by the landlord show that in some respects, the premises were not left reasonably clean and tidy, and some rubbish was not removed.
- The landlord paid $575.00 have the premises cleaned after the tenancy ended, proved by the invoice provided.
- The invoice records that a deep clean of the kitchen and bathroom and cleaning of other rooms to a reasonable standard, was undertaken.
- This was a 4-year tenancy. The tenant should meet the cost necessary for the premises to be brought to a reasonable condition but some cost for a deep clean between tenancies rests with the landlord.
- I have apportioned the cleaning cost accordingly.
- Because Carmo Investments Limited has substantially succeeded with the claim I must reimburse the filing fee.
