Miriam Wharawhara must pay rent and the debt as follows: a. Payment of rent for the period 5 to 14 July 2024, of $120.00 by no later than 14 July 2024. b. Thereafter: a. by 23 weekly payments of $108.00, being $88.00 for rent and $20.00 for the debt. b. A final payment of $99.00, being $88.00 for rent and $11.00 for the debt. c. The landlord had originally applied for termination of the tenancy, rent arrears and refund of the bond. However, at the hearing today, Ms Jaftha says the landlord is prepared to give the tenant the opportunity of avoiding termination so long as the tenant pays her rent on time from now on and makes weekly payments of $20.00 for the arrears.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order by virtue of s 55(1)(a) and (1A) Residential Tenancies Act 1986.

In this case, the landlord seeks only a conditional order, so I do not have to apply s 55(1)(a) but can adopt the landlord’s preferred outcome.

The rent is to increase from $84.00 per week to $88.00 per week on 15 July 2024. The rent due at the old rate up to 15 July is $120.00. I make an order that requires payment of that amount with the increased rent plus the instalment scheme commencing on 15 July.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach: s 64(4)(b) Residential Tenancies Act 1986.
